Refund policy

At HerSafety, we are committed to providing quality personal-safety products designed for everyday use. This Returns & Refund Policy applies to purchases made through our website and is intended to comply with applicable South African consumer-protection laws, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Nothing in this policy limits any rights you may have under South African law.

1. 7-Day Online Cooling-Off Period

If you purchase a HerSafety product online, you may cancel your purchase within 7 days of receiving the product, subject to the applicable provisions of ECTA.

Where applicable, the product should be:

  • Returned in its original condition.
  • Returned with its original packaging and included accessories where reasonably possible.
  • Accompanied by proof of purchase.
  • Returned without damage caused by misuse, negligence, or modification.

You must notify HerSafety in writing within the applicable 7-day period.

The customer is responsible for the direct cost of returning the product, where permitted by law.

Once the returned product has been received and inspected, an approved refund will be processed within the period required by applicable law.


2. Defective or Faulty Products

HerSafety products are covered by the protections provided under the Consumer Protection Act.

If your product is defective due to a manufacturing fault within 6 months of delivery, and the defect was not caused by misuse, abuse, accidental damage, or normal wear and tear, you may return the product for an appropriate remedy in accordance with the CPA.

Depending on the circumstances and applicable law, this may include:

  • Repair
  • Replacement
  • Refund

Where required by law, HerSafety will cover the reasonable cost of returning a genuinely defective product.


3. Products That Cannot Be Returned

A return may not be accepted where the product has been damaged or altered as a result of:

  • Misuse or negligence
  • Accidental damage
  • Attempted repairs or modifications
  • Damage caused by incorrect use
  • Damage caused by exposure to water or other substances where the product is not designed for such exposure
  • Excessive wear and tear
  • Use outside the product's intended purpose

This does not affect your legal rights regarding products that are defective or do not comply with the CPA.


4. Incorrect, Missing or Damaged Orders

If you receive:

  • The wrong product
  • A missing item
  • A product damaged during delivery

please contact HerSafety within 48 hours of receiving your order where possible.

Please provide:

  • Your order number
  • Your full name
  • Clear photographs of the product and packaging
  • A description of the problem

We will assess the issue and arrange an appropriate replacement, repair, or refund where applicable.


5. Refunds

Approved refunds will generally be made using the original payment method, where reasonably possible.

Shipping or delivery charges will be handled in accordance with applicable South African law and the circumstances of the return.

Where a return is caused by an error on our part or a genuinely defective product, HerSafety will meet any return costs where required by law.


6. Exchanges

HerSafety may offer an exchange where:

  • The product is defective
  • The incorrect product was supplied
  • An exchange is otherwise permitted under applicable law and the required conditions are met

Exchanges are subject to product availability.


7. Inspection of Returned Products

Returned products may be inspected before a refund, replacement, or other remedy is approved.

This inspection helps us determine whether the product is defective, damaged, incorrectly supplied, or otherwise eligible for return.

HerSafety will not use an inspection process to unlawfully limit any consumer rights provided by South African law.


8. Personal Safety Product Use

The HerSafety Personal Alarmβ„’ is designed to help attract attention during an emergency.

Customers should use the product according to its intended purpose and any instructions provided with the product.

HerSafety is not responsible for damage caused by:

  • Misuse
  • Negligence
  • Unauthorized modification
  • Accidental damage
  • Improper storage
  • Use contrary to the product instructions
  • Use outside the product's intended purpose

The HerSafety Personal Alarmβ„’ is an attention-attracting safety device and does not guarantee personal safety or prevent crime.


9. How to Request a Return

To request a return or report a problem with your order, contact us at:

  • Order Number
  • Reason for Return
  • Photos or videos of the product, where applicable

Please do not send a product back without first contacting HerSafety and receiving return instructions.


10. Your Consumer Rights

Nothing in this Returns & Refund Policy excludes, restricts, or limits any rights you may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African law.

Where any part of this policy conflicts with applicable legislation, the relevant South African law will prevail.
